Terms of Service

Version 2 · effective 18 September 2026. This version replaces all earlier Terms.

1. Who we are, and what these Terms cover

These Terms of Service ("Terms") are a binding agreement between you and:

Referred to below as "we", "us" or the "Operator". We are the data controller for personal data processed in the Game.

These Terms govern your use of the mobile game TicTacBrawl (the "Game") and its online services. Two further documents form part of your agreement with us and should be read alongside these Terms: our Privacy Policy, which explains what we do with your data, and our Content Policy, which sets out the rules for display names.

You accept these Terms when you first open the Game and confirm the acceptance prompt. You can play as a guest without registering, but these Terms apply to guests exactly as they apply to registered players. If you do not accept them, do not use the Game.

The Game is not offered in every territory, and we may make it unavailable in a given country.

2. Age

You must be at least 13 years old to play TicTacBrawl. The Game is not directed at children under 13 and we do not knowingly allow them to play.

If you are under the age of majority where you live, you may only use the Game with the agreement of a parent or guardian, who accepts these Terms on your behalf and is responsible for your use of the Game — including any purchases made from a device they control.

Some countries set a higher minimum age than 13 for certain uses of personal data. Where your country does so, that higher age applies to you for those purposes, and our Privacy Policy explains what this affects.

We do not ask your age in the Game. If you tell us that an account belongs to someone below the applicable age, we will close it and delete the data associated with it.

3. Your licence to play

We grant you a personal, non-exclusive, non-transferable, revocable licence to install and play the Game for your own private entertainment. Everything in the Game — the code, the artwork, the hero designs, the audio, the rules and the servers — stays ours, and nothing here transfers ownership of any of it to you.

This licence does not limit any right you have under mandatory law, including your right under EU law to decompile software for the purpose of interoperability.

4. Gems, Coins, Shards, Dust and other virtual items

The Game uses virtual currencies — Gems, Coins, Hero Shards and Dust — and virtual items such as the Battle Pass, the Sponsor subscription, heroes, pets and cosmetics.

These are a licence to use features inside the Game. They are not money, they have no value outside the Game, and they cannot be cashed out, sold or transferred to anybody else. We may change what any of them costs or does as we balance the Game.

What happens to your balances:

Randomised items. Some items are obtained from draws with a random outcome. The probability of each outcome is published in the Game before you draw, together with any guarantee that applies after a set number of draws. Those published numbers are the ones the Game actually uses.

Rewarded advertising. The Game may offer you the option to watch an advertisement in return for a small reward. Watching is always optional and never required to play.

5. Buying things — and your right to cancel

All purchases in TicTacBrawl are made through Google Play Billing. Google, not us, is the seller for those purchases. Your payment contract is with Google, it is governed by the Google Play Terms of Service, and refunds are handled under Google’s refund policy through your Google account. We do not take your payment details and we cannot see them.

If you live in the EU, the EEA or the UK, you normally have 14 days to withdraw from a distance purchase. For digital content delivered immediately, that right ends once delivery begins — but only where you asked for immediate delivery and acknowledged that you would lose the right. Google asks for that confirmation at the moment of purchase, as part of the Play checkout. We do not ask you to waive anything here, in advance, for purchases you have not yet made.

The Sponsor subscription renews automatically for the period you selected until you cancel it. You manage and cancel it in the Google Play subscription settings on your device or at play.google.com — not in the Game. Cancelling stops the next renewal; it does not shorten the period you have already paid for. If we change the price, Google will notify you and ask you to confirm before the new price takes effect.

Nothing in this section removes any right you have under mandatory consumer law, including your right to a remedy if what you bought does not work as described.

6. How to behave

You agree not to:

Note on automated opponents. The restriction above applies to you as a player. We operate our own automated accounts as part of running the Game — in particular, so that ranked and practice matches can find you an opponent quickly at times when few players are queuing. You may be matched against one.

If you break these rules we may warn you, restrict features of your account, suspend it temporarily, or close it permanently — proportionate to what happened. Where we close or suspend an account we will tell you why, and you may contest it by writing to [email protected].

Reporting. If you see a display name that breaks the Content Policy, you can report it from the Game. We review reports and act on them.

7. Leaderboards and what other players see

Your display name, your rank and your season results are visible to other players — in matches, on the public leaderboard and on your profile. Choose a display name accordingly, and do not use your real name if you would rather it were not public.

8. Availability, changes to the Game, and our responsibility

We want the Game to work, and we will make reasonable efforts to keep it available — but it is an online service, and we cannot promise it will be uninterrupted or error-free. We may take it down for maintenance, change or remove features, adjust game balance, or end a season.

To the extent the law allows, we are not liable for indirect or consequential loss, for loss of virtual items caused by something outside our reasonable control, or for interruptions to the service.

Nothing in these Terms limits or excludes our liability for death or personal injury, for damage caused intentionally or through gross negligence, for fraud, or for anything else that cannot be limited under Czech or EU law. If you are a consumer, your statutory rights are unaffected by this section.

9. Ending it

You can stop at any time. You can delete your account from Settings › Account in the Game. If you play as a guest and have no way to sign in, you can still ask us to delete your account by sending us your Support ID — the account deletion page explains how, and it works for guests too.

We can end it too, for the reasons in section 6, or if we discontinue the Game.

10. Changes to these Terms

We may update these Terms — for example if the law changes, or if we add or remove features. When we make a change that matters to you, we will show you the new Terms in the Game and ask you to accept them before you carry on playing. The version number and effective date at the top of this page tell you which version you are looking at.

If you do not accept a new version, you can stop playing and delete your account as described in section 9.

11. Complaints and disputes

If something is wrong, please write to [email protected] first — most things are quicker to fix that way. We will confirm we have your complaint within two working days and tell you how we intend to deal with it.

If we cannot resolve it between us and you are a consumer, you have the right to take the dispute to out-of-court resolution. The competent body in the Czech Republic is the Česká obchodní inspekce (Czech Trade Inspection Authority), Štěpánská 796/44, 110 00 Praha 1, www.coi.cz. Using it is free for you and does not affect your right to go to court.

For a problem with a payment — a charge you did not expect, or a refund — contact Google Play support, because Google is the seller.

12. Governing law

These Terms are governed by the law of the Czech Republic.

If you are a consumer resident in the EU or EEA, this choice does not deprive you of the protection of the mandatory consumer law of the country where you live, and you may bring proceedings in the courts of that country. We will bring any claim against you in the courts of your country of residence. For everyone else, the courts of the Czech Republic have jurisdiction.

13. Odds and ends

If any part of these Terms turns out to be unenforceable, the rest continues to apply. If we do not enforce something straight away, we have not given up the right to enforce it later. We may transfer our rights and obligations under these Terms to somebody else, provided your rights are not reduced.
